Protective Orders are civil orders intended to protect someone from the abuse or harm of another.  They are often referred to as restraining orders.  They can be sought in the General District Court or in the Juvenile and Domestic Relations District Court.

 

Generally speaking, the standard for a judge to issue a protective order is whether the petitioner can show the Court that he or she was subjected to an act of violence, force, or threat that resulted in bodily injury or at least placed him or her in reasonable fear of death, sexual assault, or bodily injury.

 

If a protective order is issued against a party, it acts as a legal prohibition against that person.  It often demands no contact and no communication.

 

Protective orders are serious matters.  They restrict one’s liberty in a variety of ways, including potentially impacting one’s right to possess or transport firearms.
